These Terms of Service (“Terms”) govern your use of motorvated.coffee and your purchases from Motorvated LLC (“Motorvated,” “we,” “us,” or “our”). By accessing our website, creating an account, placing an order, or enrolling in a subscription, you agree to these Terms.

1. Our Store

Motorvated sells fresh-roasted coffee, automotive-inspired apparel, subscriptions, and related products. We may also offer promotional rewards, discounts, affiliate recommendations, and limited-time campaigns.

We reserve the right to update our products, prices, promotions, and website content at any time. Product availability is not guaranteed.

2. Eligibility and Customer Accounts

You must be at least 18 years old or the age of majority in your jurisdiction to create an account, place an order, or enroll in a subscription. If you allow another person to use your account, you are responsible for activity conducted through that account.

You agree to provide accurate and current information and to protect your login credentials. We may suspend or terminate accounts associated with fraud, misuse, unauthorized activity, or violations of these Terms.

3. Product Information

We make reasonable efforts to display product descriptions, colors, ingredients, sizes, and images accurately. Actual colors and appearance may vary based on your device, product materials, production batches, or other factors.

Coffee roast profiles, flavor notes, and tasting descriptions are provided as general guidance. Individual taste experiences may vary. Please review product labels and ingredient information before use, especially if you have allergies, sensitivities, or dietary restrictions.

4. Orders, Prices, and Payment

Prices are shown in U.S. dollars unless otherwise stated. Taxes, shipping charges, and available discounts are calculated during checkout.

Submitting an order does not guarantee acceptance. We may decline, limit, or cancel an order because of inventory issues, pricing errors, suspected fraud, payment problems, shipping restrictions, or other legitimate business reasons. If we cancel an order after payment has been collected, we will refund the canceled amount to the original payment method.

Discount codes and promotional offers cannot be combined unless expressly stated. Promotions may be changed or discontinued subject to applicable law.

5. Coffee Subscriptions and Recurring Billing

When you enroll in a Motorvated coffee subscription, you authorize us and our payment provider to charge your selected payment method automatically at the frequency and price shown during enrollment until you cancel.

The subscription price, delivery frequency, selected products, shipping benefits, and other material terms will be displayed before you complete enrollment. Subscription orders may also earn Fuel Points at the rate shown in the Motorvated Fuel Points program.

You may manage your subscription through your customer account, including changing eligible product selections, adjusting your delivery schedule, skipping an upcoming delivery, or canceling future renewals.

Subscription changes or cancellations must be completed before the next scheduled charge. Canceling stops future renewals but does not automatically cancel an order that has already been processed or shipped.

There is no three-shipment minimum commitment unless a particular offer clearly states otherwise before enrollment. If we materially change a subscription’s price or recurring terms, we will provide advance notice where required by law.

6. Shipping and Delivery

Processing and delivery estimates are provided for convenience and are not guaranteed delivery dates. Fresh-roasted coffee and made-to-order products may require additional processing time.

Customers are responsible for providing a complete and accurate shipping address. Please contact us promptly if you discover an address error. Once an order has entered fulfillment, we may be unable to change its destination.

Free-shipping offers, including promotions based on the number of eligible products in a cart, are subject to the conditions displayed with the offer. Certain destinations, expedited services, or products may be excluded where disclosed.

7. Returns, Refunds, and Order Problems

Returns, exchanges, refunds, damaged products, incorrect items, and subscription orders are handled according to our Return and Refund Policy, which is incorporated into these Terms.

If an order arrives damaged, defective, or incorrect, contact support@motorvated.coffee within seven days of delivery and include your order number, a description of the problem, and clear photographs of the item and packaging.

8. Motorvated Fuel Points

Motorvated Fuel Points are promotional loyalty rewards that may be earned and redeemed according to the rates and conditions displayed in our rewards program.

Fuel Points:

• Have no cash value and cannot be exchanged for cash;
• Are personal to the associated customer account and may not be sold or transferred;
• May be subject to expiration dates or redemption restrictions shown in the program;
• May be adjusted or removed when an order is canceled, returned, refunded, determined to be ineligible, or associated with misuse or fraud; and
• May not be combined with every offer or discount.

We may update the Fuel Points program, earning rates, available rewards, or eligibility requirements. We will provide notice of material changes where required by applicable law.

9. Promotions and Giveaways

Motorvated may occasionally offer discounts, social media promotions, contests, sweepstakes, or giveaways. Each promotion may be governed by separate terms, eligibility requirements, entry instructions, deadlines, prize details, or official rules presented with that promotion.

If promotion-specific rules conflict with these Terms, the promotion-specific rules will control for that promotion. No purchase will be required where prohibited or otherwise required by applicable law.

Unless expressly stated, social media platforms such as Instagram, Facebook, TikTok, and YouTube do not sponsor, endorse, administer, or have any association with Motorvated promotions.

10. Affiliate Links

Some pages, articles, social posts, or product recommendations may contain affiliate links. Motorvated may receive a commission when you make a qualifying purchase through one of these links, at no additional cost to you.

As an Amazon Associate, Motorvated earns from qualifying purchases.

11. Communications

We may send transactional communications concerning orders, subscriptions, account activity, shipping, security, or customer-service requests.

Marketing email or text-message consent is separate from your agreement to these Terms and is not required to make a purchase. You may unsubscribe from marketing emails using the link provided in the message. Text-message instructions and any applicable messaging rates will be disclosed when you enroll.

12. Intellectual Property

Motorvated’s website content—including its name, logos, designs, photographs, graphics, product names, written content, and other materials—is owned by or licensed to Motorvated and is protected by applicable intellectual-property laws.

You may use the website for personal, noncommercial shopping purposes. You may not copy, reproduce, modify, distribute, sell, scrape, republish, or commercially exploit our content without prior written permission.

13. Prohibited Conduct

You may not use our website or services to:

• Violate any applicable law or regulation;
• Commit fraud or provide false payment, account, or shipping information;
• Interfere with the website’s security or operation;
• Introduce malicious software or attempt unauthorized access;
• Abuse discounts, Fuel Points, referrals, promotions, or customer accounts; or
• Infringe the rights of Motorvated or another person.

14. Third-Party Services and Links

Our website may use or link to third-party services, including Shopify, payment processors, subscription providers, shipping carriers, social networks, and affiliate retailers. Those services may have their own terms and privacy practices.

Motorvated is not responsible for the content, availability, security, or practices of independent third-party websites.

15. Privacy

Our collection and use of personal information are described in our Privacy Policy. By using our website, you acknowledge that you have reviewed that policy.

16. Disclaimer of Warranties

To the fullest extent permitted by law, the website and its content are provided on an “as available” basis. We do not guarantee that the website will always be uninterrupted, secure, or free from errors.

Nothing in these Terms limits warranties or consumer rights that cannot legally be excluded.

17. Limitation of Liability

To the fullest extent permitted by law, Motorvated will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the website, products, or services.

Motorvated’s total liability for a claim relating to a product or order will not exceed the amount you paid for the product or order giving rise to that claim. These limitations do not apply where liability cannot legally be limited or excluded.

18. Changes to These Terms

We may update these Terms to reflect changes to our products, services, business practices, or legal obligations. The updated version will be posted on this page with a revised “Last updated” date.

Your continued use of the website after an updated version becomes effective constitutes acceptance of the revised Terms to the extent permitted by law.

19. Severability

If any provision of these Terms is determined to be unlawful or unenforceable, the remaining provisions will continue in effect.

20. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, while preserving any consumer rights that apply under the laws of your jurisdiction.
